The act includes rules and procedures for altering or demolishing municipal heritage properties and protecting the heritage value of protected buildings.
Applications to deregister a Municipally designated heritage properties may be heard by Municipal Council after holding a public hearing to consider the proposed deregistration.
Deregistration may be granted where there has been irreversible structural damage or deterioration to the building or structure; or the continued registration of the property appears to Council to be inappropriate as a result of the loss of the property's heritage value. Abandonment and neglect of a property is not a basis of an application for deregistration.
The time period for municipalities to consider applications for substantial alteration or demolition of a municipally registered heritage property is three years. Municipalities, property owners and developers are encouraged to use the time period for dialogue. If the application is not approved by the municipality at the end of three years and the changes are carried out, the municipality may choose to deregister the property.
Penalties for corporations that substantially alter or demolish a registered property without permission range up to to $250,000. Penalties for individuals who do not follow the act are up to $10,000.
